The Madrid Court annuls the decision for a jury to judge Begoña Gómez.

The Provincial Court of Madrid has revoked the resolution of investigating judge Juan Carlos Peinado, who had decided that a jury should judge Begoña Gómez, the wife of the Prime Minister. The Court considers that no evidence has been presented to justify continuing with this process. The tribunal has instructed the judge to reverse his decision and return to the previous state of the case involving Begoña Gómez, her adviser Cristina Álvarez, and businessman Juan Carlos Barrabés, just before the proceedings were transformed into a jury trial. Section 23 of the Madrid Court has criticised the judge, arguing that it is unacceptable to make a decision like adjusting the case to jury procedures without specifying to the investigated parties what behaviours justify that decision and what evidence supports the accusation. The judges have given a partial response to the appeals presented by the three investigated individuals, considering that Peinado’s resolutions, due to their lack of justification and the absence of a narrative including indications, infringe the right to effective judicial protection.
