The judge of the case summons former president Carlos Mazón to testify as a witness.

The judge in Catarroja handling the criminal case related to the management of the DANA (a weather phenomenon causing heavy rainfall) in Valencia has decided to summon the former president of the Generalitat, Carlos Mazón, as a witness. The instructor made this decision in an order that was notified to the parties on Tuesday, in which it states that the order issued by the Civil and Criminal Chamber of the Superior Court of Justice of Valencia, following the submission of a reasoned exposition to request an investigation into Mazón, “excludes” his “responsibility in its omissive aspect, as he does not have the position of guarantor.” According to what the TSJCV indicates, the judge mentions that the Superior Court of Justice of the Valencian Community «also does not find indications of a crime in the conduct of the public figure in a possible active participation» in the sending of the Es-Alert message on 29 October 2024, the day when the floods occurred that caused 230 deaths. Thus, it states that «it is not possible to make a preliminary assessment regarding the gathering of evidence during the investigation that could lead to possible criminal responsibilities of Mr. Carlos Mazón. This is an uncertain situation that cannot be an obstacle, following the decision of the TSJ, to agree to his testimony as a witness.» The order states that his testimony and the request to Mazón to contribute messages and phone calls from 29 October 2024, which are linked to the DANA, will take place once the order from the TSJCV, issued on 16 March of last year, becomes definitive.
