The Public Prosecutor’s Office of the Supreme Court has requested the higher court to overturn the decision that imposed a fine of 7,200 euros and a two-year disqualification from serving as Attorney General on Álvaro García Ortiz due to a crime of disclosing confidential information. In a document signed by María de los Ángeles Sánchez Conde, the Public Ministry presents a nullity incident due to the violation of the right to the presumption of innocence, the denial of defence, as well as the infringement of the right to legal certainty and effective judicial protection. For these reasons, it requests the Supreme Court to overturn the conviction and also annul the compensation of 10,000 euros that García Ortiz is required to pay to Alberto González Amador for the damages he allegedly caused by disclosing confidential information related to his negotiations with the Public Prosecutor’s Office regarding tax offences.
